
The Chairman of the Board of the Real Estate Regulatory Authority (RERA), Essam bin Abdullah Khalaf, has issued Decision No. (1) of 2026, introducing a new Article (59 bis) to Decision No. (1) of 2020 regarding the regulation of Owners’ Associations in jointly owned properties.
The first article of the decision, as published in the Official Gazette, stipulates that the effective voting threshold in general assembly decisions is reached when the ownership share of an owner or developer in jointly owned units—or their voting weight—exceeds 50%. In such cases, the votes or voting weight of the owner or developer shall be calculated as 50%, regardless of their actual ownership percentage or voting weight.
The decision also mandates that the Chief Executive and relevant parties shall implement its provisions, and it will come into effect on the day following its publication in the Official Gazette.
